Below please find a copy of the e-mail containing the WARNINGS issued by the European "Green-8" Group several months ago.
 
In a nutshell, and with due regard for some of the statements in the e-mail below, it seems to me the EU Constitution (in its present form) has been designed to make smithereens of the Aarhus Convention Agreement.
 
That is why the "elected-dictators" (as I see them) don't want anybody here to know anything about the Aarhus Convention Agreement at the present time - to the point where the Republic of Ireland Government has been violating Bunreacht na hEireann (the Constitution of the Republic of Ireland) on an ongoing basis for several years now: AND BREAKING THE LAW IN THE PROCESS (for the reasons outlined at http://www.finnachta.com/Hotmail24Oct2004/Euro52billion.htm). 
 
Later, and assuming the elected-dictators can hoodwink enough people here into accepting the EU Constitution in its present form, they will then be very happy - no doubt - to talk endlessly in public about all the wonderful "benefits" of the Aarhus Convention Agreement - which by that time they will have slyly rendered completely useless as far as the vast majority of EU citizens are concerned.  Nevertheless, I believe enough "shadows" of the Aarhus agreement will be left in the EU Constitution to make a fine piece of "window-dressing" - for the purpose of supporting the illusion of genuine democracy: as in "government of the people, by the people, for the people". 
 
As it is the case that NOBODY IS ABOVE THE LAW (Article 40 in the "Fundamental Rights" section of the Republic of Ireland Constitution), I personally feel the time has come when one or more people connected with our Government should be taken before our courts of law regarding the extremely serious matter referred in paragraph 3 above.  
 
Incidentally, and as you may already know, EU leaders are meeting in Rome tomorrow to sign the EU Constitutional Treaty.  Following that, I assume there will be a constitutional referendum here regarding the matter.  (I find it interesting that Rome, the power-base of Julius Caesar's Empire, has been chosen for the meeting: a Freudian slip of sorts perhaps?) 
 
My hope is that the people of the Republic of Ireland will reject the EU Constitution: UNLESS  AND  UNTIL the FULL set of benefits of the Aarhus Convention Agreement signed by the Republic of Ireland on June 25th 1998, please see http://www.unece.org/env/pp/ctreaty.htm, are clearly available in the EU Constitution text for all citizens of this State.   FULL  DUCK  OR  NO  DINNER !!

Section 3, CHAPTER V, PART III (titled "Culture") seems to make no direct reference at all to the protection of heritage sites such as (for example) those which are at present under VERY serious threat because of planned road projects in the Tara (County Meath) and Turoe (County Galway) areas. The archaeological landscape in the Turoe area is also under severe threat at the present time from a planned "Superdump for Connacht" project which, given the chance, could become the "Mother of all Superdumps".  Please see:

The Århus Convention Agreement
 (3 Main Points)

The Århus Convention establishes a number of rights of the public (citizens and their associations) with regard to the environment. Public authorities (at national, regional or local level) are to contribute to allowing these rights to become effective. The Convention provides for:

  1. The right of everyone to receive environmental information that is held by public authorities (“access to environmental information”). This can include information on the state of the environment, but also on policies or measures taken, or on the state of human health and safety where this can be affected by the state of the environment. Citizens are entitled to obtain this information within one month of the request and without having to say why they require it. In addition, public authorities are obliged, under the Convention, to actively disseminate environmental information in their possession;
     

  2. The right to participate from an early stage in environmental decision-making. Arrangements are to be made by public authorities to enable citizens and environmental organisations to comment on, for example, proposals for projects affecting the environment, or plans and programmes relating to the environment, these comments to be taken into due account in decision-making, and information to be provided on the final decisions and the reasons for it (“public participation in environmental decision-making”);
     

  3. The right to challenge, in a court of law, public decisions that have been made without respecting the two aforementioned rights or environmental law in general (“access to justice”).
