Dear Prime Minister Ahern,

Despite a number of reminders to Mr Geraghty, and to two of his lawyer colleagues at law-firm Fair Murtagh, I have STILL not received any reply from them to my letter dated December 21st 2004.

I have reproduced the text of my December 21st 2004 letter below, and with reference to Paragraph 1, I wish you to know that I still wish to sue the State for wrongful acts for its public servants.

One of the practical consequences for me personally, of one of the wrongful acts I refer to, means that TWO huge rubbish dumps will (if they ever actually do go-ahead) be located close to my home in New Inn, County Galway: one a mile or so to the east in Kilconnell, and the other a mile or so to the west in the Ballyfa/Cross area.

I understand that work is due to start on the Kilconnell rubbish dump this coming April, which of course is now only weeks away. 

Well before any work begins at the Kilconnell or Ballyfa/Cross rubbish dumps, I wish to formally initiate a High Court challenge regarding the constitutionality of the alterations (made during and since 2001) to the Waste Management Act: which removed decision making powers from my elected local government representatives (i.e. the Galway County Councillors) regarding the location of such large rubbish dumps. 

As I have related to you and your colleagues SEVERAL times during the past few years, I am entirely convinced that the alterations in question are in blatant breach of Article 28A of the Constitution of the Republic of Ireland, for the reasons I set out in my appeal to An Bord Pleanala dated February 21st 2004, which can be viewed at Internet location: http://www.finnachta.com/BordPleanalaAppeal.htm

Please note that I have also raised the Article 28A violation matter in the written submission I made on September 4th 2004 relating to the Review of the Connaught Regional Waste Management Plan, the text of which can be seen at: http://www.finnachta.com/ConnaughtWasteManagementReview.htm

To the very best of my knowledge and understanding, the Republic of Ireland is not just a "democracy": it is a CONSTITUTIONAL  DEMOCRACY; and, part of that Constitution (Article 40) is devoted to the "Personal Rights" of all citizens.

Article 40.3.1 states: "The State guarantees in its laws to respect, and, as far as practicable, by its laws to defend and vindicate the personal rights of the citizen."

Article 40.3.2 goes on to say: "The State shall, in particular, by its laws protect as best it may from unjust attack and, in the case of injustice done, vindicate the life, person, good name, and property rights of every citizen."

In the complete absence of any explanation - from anybody - as to why law-firm Fair Murtagh appears to be completely ignoring the letters I sent to them through the registered post on December 21st 2004, and November 30th 2004, I do not know who exactly is responsible for their failure to reply to me. Nevertheless, I believe that whoever they are, they are grossly compounding the already shocking situation regarding the ongoing unlawful interference with my constitutional rights, by public servants acting on behalf of the State of the Republic of Ireland (or "Eire" or "Ireland" as it is referred to in Article 4 of the Constitution).

I further believe that you, and indeed ALL of your public servant colleagues in ALL three of the main organs of government, have an extremely important duty to ensure that I and all other citizens of the Republic of Ireland have easy access to the services of lawyers when we need to legally defend ourselves against unlawful interference with our constitutional rights. 

Consequently, I would be very grateful if you would look into the matter of why law-firm Fair Murtagh is failing to reply to my letters, and to take whatever steps are necessary to ensure that I am provided with the services of lawyer - WITHOUT  ANY  FURTHER  ADO  PLEASE - who will act on my behalf, and in my best interests.

Assuming, as appears to me to be the case, that your thoughts (and your efforts?) regarding the possibility of amicably resolving the matter of the extant warrant for my arrest have come to nothing, please note that I now wish to sue the State for the wrongful acts of public servants which I have been subjected to - as I have already indicated to you in my e-mail dated November 29th (which has been copied to the following Internet location:

Please note that the attempt to corruptly criminalise me, and to possibly lock me up in jail as well I suspect, in connection with a "crime" which has been INVENTED, is just one of a long list of wrongful acts by public servants that I have been exposed to since 1998.
 
For the purpose of starting proceedings, which I wish you to begin as SOON as possible please, the wrongful act which concerns me most at the present time is the one relating to the Aarhus Convention Agreement (referred to below).
 
In terms of benefits for the People of the Republic of Ireland (whose numbers include myself of course), and with due regard for its enormous potential to reduce a wide and growing range of social problems in our society, I view the Aarhus Convention Agreement as the most important international agreement of its kind ever to have been signed.  
 
Despite its widely recognised importance (among those who have managed to find out about it despite all of the well organised and almost water-tight censorship), our government has been doing everything it possibly can to keep the People of the Republic of Ireland completely in the dark regarding the Aarhus Convention Agreement: to the amazing extent that it has been blatantly violating a very important section of the fundamental law of the State (i.e. Article 29.5.1 of the Republic of Ireland Constitution) for several years now. 
 
As many who are well informed on the subject would readily agree (I believe), what happens in the Republic of Ireland regarding the Aarhus Convention Agreement may well have huge knock-on effects for the Peoples of many other states in Europe, and in the rest of the world as well.
 
As can be seen below, I have now raised the matter of law-breaking by government with Prime Minister Ahern, and with 231 other Oireachtas members, through a set of 8 e-mails sent in recent days similar to the one further down dated Sat, 18 Dec 2004.
 
If I am arrested, I intend to hand a copy of this e-mail to the person/s concerned, refer them to your law firm (Fair Murtagh), and then remain silent.
 
If I am taken before the courts against my wishes, it is my intention to remain silent (which I assume I have a legal right to do): unless and until such time as I have a lawyer BY MY SIDE in court to defend me, who is THOROUGHLY familiar with my case.

Dear Mr Geraghty,

In fear for my life, and with due regard for the contents of the two e-mails copied below, I hurriedly left the Republic of Ireland jurisdiction in the early hours of December 7th 2004.

Later that day (i.e. December 7th 2004), I was admitted to hospital under the care of Consultant Psychiatrist Dr. Foster in Omagh, County Tyrone, Northern Ireland.

Much to my surprise, and to the surprise of hospital staff, I was suddenly discharged from hospital yesterday - straight out onto the street, and COMPLETELY against my wishes. Dr Foster claimed (repeatedly) this was entirely in order for him to do this because he could find no evidence that I was suffering from any form of mental illness. Requests by me for a second opinion (on the decision to discharge me yesterday) from a different consultant psychiatrist were also repeatedly refused.

Dr Foster's actions seem to mirror the actions of Dr. Jacque Maurice in Shrewsbury in or around October 2002. At first they were both very helpful; and then, suddenly and without any reasonable explanation, they both appeared to go cold and withdraw their help: as though they had been instructed by their supperiors to do so. In the case of Dr. Foster, his unexplained change-of-heart was ruthlessly vicious and insulting, and witnessed by several members of staff.

Requests made to discuss my safety situation with members of the Northern Ireland police force, BEFORE I was discharged from hospital yesterday, were also repeatedly refused: for no good reason that I know of. Consequently, I am now afraid to seek help from members of the Northern Ireland police force.

My money is running out and I do not feel well enough, or safe enough, to go through the process of having money transferred to me from the Republic of Ireland to a Northern Ireland bank. Consequently, I now fear that I will soon end up living on the streets.

Please note that Dr Foster and his support staff were all made fully aware of my overall situation at various times during my recent seven day stay in hospital. Please also note that I am copying this e-mail to the Secretary of the Northern Ireland Health & Social Services Board, in the hope that the person in question will URGENTLY investigate Dr Foster's behaviour relating to my recent treatment in Omagh under his care.

As my ongoing situation has all along involved a number of very basic human rights issues, I am now copying this e-mail to the Northern Ireland Ombudsman, the UK Ombudsman, the Republic of Ireland Ombudsman, and the European Community Ombudsman.

I am also copying this e-mail to the Northern Ireland police: in the hope that I will receive a written assurance from them (i.e. an e-mail to the address provided below) that it is safe for me to go to a police station to discuss my present security situation with them.

Please let me know what (if anything) you, or your lawyer colleagues at Fair-Murtagh plan to do regarding my present situation (as outlined above). Despite Ciara Macklin's request below, I am reluctantly copying this e-mail to her nonetheless. This is because I have not received any reply from you to a number of letters I have sent to you through the registered post during the past two years or so. Working from memory only, there are least two such letters, and possibly as many as four. In addition, I have not received any reply to several e-mails I have sent to both yourself, and to Mr Egan (Principal Lawyer at Fair-Murtagh) during the same period.

Dear Ms Macklin,

Following our meeting when I called to your office in Ballinasloe this afternoon, it is now my understanding that Mr Geraghty is ill in bed and that he will not be able to be in court to defend me on Wednesday in Loughrea.

Under these circumstances (which are of course completely beyond my control), it would be much appreciated if you could contact the appropriate people in the court system to defer my being taken before the courts until such time as I have a lawyer who is familiar with my case to defend me.

As I mentioned to you this afternoon, I feel I very badly need the services of lawyer who is willing to defend me against the wrongful acts of public servants who are acting on behalf of the State; and, that without such a lawyer, PLEASE NOTE that I am TERRIFIED of appearing before the courts. It is PRECISELY because I was unable to find such a lawyer that I did not attend the court in Loughrea in October 2002. Unfortunately, and despite my best efforts during the two years in between, I STILL cannot find such a lawyer. I do not see this as my fault. I see it as the fault of the legal system in the Republic of Ireland: which appears to be acting as an arm (or fist) of the Government - with no regard for the tripartite separation of powers embedded in our constitution.

I repeat, after searching for several years, both before and after October 2002, I STILL CANNOT FIND A LAWYER WHO WILL DEFEND ME AGAINST THE WRONGFUL ACTS OF PUBLIC SERVANTS ACTING ON BEHALF OF THE STATE.

Please note that I have ALREADY provided Mr Geraghty and Mr Egan with much written evidence over the past 23 months or so of wrongful acts committed by public servants acting on behalf of the State: and that much of this evidence can be seen on the pages of the three Internet web sites listed below.

Later this evening, I plan to give printed copies of this e-mail to Garda Tom Kenny, to my brother Mr Gerald Finnerty, and to my half-sister Ms Margie Dolan.

The Århus Convention Agreement
 (3 Main Points)

The Århus Convention establishes a number of rights of the public (citizens and their associations) with regard to the environment. Public authorities (at national, regional or local level) are to contribute to allowing these rights to become effective. The Convention provides for:

  1. The right of everyone to receive environmental information that is held by public authorities (“access to environmental information”). This can include information on the state of the environment, but also on policies or measures taken, or on the state of human health and safety where this can be affected by the state of the environment. Citizens are entitled to obtain this information within one month of the request and without having to say why they require it. In addition, public authorities are obliged, under the Convention, to actively disseminate environmental information in their possession;
     

  2. The right to participate from an early stage in environmental decision-making. Arrangements are to be made by public authorities to enable citizens and environmental organisations to comment on, for example, proposals for projects affecting the environment, or plans and programmes relating to the environment, these comments to be taken into due account in decision-making, and information to be provided on the final decisions and the reasons for it (“public participation in environmental decision-making”);
     

  3. The right to challenge, in a court of law, public decisions that have been made without respecting the two aforementioned rights or environmental law in general (“access to justice”).
